TERMS AND CONDITIONS

Definitions

  • In these Terms of Business, “We”, “Us” and “Our” refers to Claim My Tax Ltd. Claim My Tax Ltd is a registered company (company number: 10858545) and our registered office is 28 Orchard Road, St. Annes on sea, Lytham, Lancashire, FY8 1PF.
  • This Agreement forms a contract between you the ‘Client(s)’ and Claim My Tax Ltd and you should read all the agreement and services that Claim My Tax Ltd provide, including any fees payable to them before signing the contract.

 

The Claims Services

  • Please note Claim My Tax Ltd provides tax rebate services in connection with overpayment of tax in the years stated on the claim form. Overpayment of tax can arise from many factors including but not limited to; marriage allowance rebates, tax deductions on personal savings allowance and/or work-related tax rebates. The services Claim My Tax Ltd provides involves investigating and advising upon a potential tax rebate paid by to the client from Her Majesty Revenue & Customs (HMRC).
  • In very brief terms, the following are the typical steps Claim My Tax Ltd would undertake in the course of providing tax rebate services: (a) obtaining initial instructions from the client as to all relevant circumstances giving rise to the tax payment; (b) assessing the information provided and advising the client as to the possibility of claiming a tax rebate; (c) preparing the necessary documentation for a tax refund to be submitted to HMRC; (d) engaging the respondent to the point of settlement with HMRC and confirmation of tax rebate.
  • The client is aware that they could approach HMRC directly at no cost.

 

Client’s Obligations

  • Claim My Tax Ltd considers that client co-operation is paramount in the rebate process as it enhances the prospects of success. That so, the commitment Claim My Tax Ltd expects from clients is as follows: (a) providing information and instructions when requested and promptly; (b) completing paperwork; (c) co-operating with Claim My Tax Ltd at all times in the course of the claim process; and (d) not misleading Claim My Tax Ltd in any way.
  • We are required to identify our clients for the purposes of the UK anti-money laundering legislation. We may request from the client and retain such information and documentation as we require for these purposes.
  • By making a claim with Claim My Tax Ltd, the client agrees that in some cases we may use a third party agency in order to verify the clients identity. The search is similar to those performed by price comparison websites and does not impact the clients credit rating however the search may be visible on their credit file.
  • HMRC may request more information about the client in order to process their claim. We will request this from the client however we are not liable for any delays caused if/when this occurs.
  • After the 14 days cooling off period, if the client fails to provide the information required for HMRC to process their claim, both prior to submitting the claim, and post submission to HMRC, Claim My Tax Ltd reserve the right to charge a fee of which will be calculated at £25 per hour to a maximum of 3 hours, for work carried out with regards to the tax rebate.
  • As soon as we have received a payment from HMRC in relation to the clients tax rebate, we will contact the client to obtain their bank details to enable us to make the payment to the client. If the client fails to respond to us after 6 months of attempted contact, Claim My Tax Ltd reserve the right to stop contact, close the case and return the money to HMRC minus our fee (at HMRC’s discretion).

 

How Claim My Tax Ltd Keeps its Clients Updated?

 

  • Throughout the rebate process, Claim My Tax Ltd provides updates to the client of all material developments. Claim My Tax Ltd will communicate generally with the client via telephone, post, email & SMS messages.

 

Claim My Tax Ltd Fees

  • Once a client enters a contract with Claim My Tax Ltd, pursuant to the Terms of Business, Claim My Tax Ltd would be entitled to charge a fee. The fees are broken down below and an example is provided for clarity.
  • Marriage Tax Claims
    • whichever is greater out of (a) 35% plus VAT + £50 plus VAT administration charge on the gross amount of rebate received; or (b) £50 plus VAT minimum fee for each rebate. In the event that the rebate is less than £50 any further balance due that hasn’t covered the minimum fee will be ignored and the client will not be charged.
      • Example Refund Received
        Tax Refund = £1000.00
        Fee charged @ 35% plus VAT = £420

Admin Fee = £50.00 plus VAT = £60

Total Fee = £480
Consumer Receives = £520

  • PPI Tax Claims
    • whichever is greater out of (a) up to 48% including VAT on the gross amount of rebate received; (b) £50 £50 plus VAT minimum fee for each rebate. In the event that the rebate is less than £50 any further balance due that hasn’t covered the minimum fee will be ignored and the client will not be charged.
      • Example Refund Received
        Tax Refund = £1000.00
        Fee charged @ up to 48% including VAT = £480

Total Fee = £480
Consumer Receives: £520

 

  • Income Tax Claims
    • whichever is greater out of (a) 30% plus VAT on the gross amount of rebate received; or (b) £25 plus VAT minimum fee for each rebate. In the event that the rebate is less than £25 any further balance due that hasn’t covered the minimum fee will be ignored and the client will not be charged.
      • Example Refund Received
        Tax Refund = £1000.00
        Fee charged @ 30% plus VAT = £360

Total Fee = £360
Consumer Receives = £640

  • If the redress recovered by Claim My Tax Ltd is used by the respondent towards arrears owed to HMRC, the client remains liable to pay out of his/her own funds the fee chargeable by Claim My Tax Ltd.
  • The primary payment method used to pay our clients is by BACS bank transfer. When a payment is received from HMRC, the client will be contacted to securely provide their sort code and account number and their refund will be paid minus our fee. If the client wishes to be paid by an alternative method, this will be considered on a case by case basis.
  • If the client fails to respond to us after 6 months of attempted contact, Claim My Tax Ltd reserve the right to stop contact, close the case and return the money to HMRC minus our fee (at HMRC’s discretion).

 

The Right to Cancel

  • The client can cancel their agreement with Claim My Tax Ltd at any time within 14 days of the client’s signature being obtained by Claim My Tax Ltd without giving any reason and without incurring any liability unless the client or Claim My Tax Ltd receives any correspondence relating to the rebate amount or receives a tax rebate from HMRC within this period; in which case Claim My Tax Ltd’s fee will be due. The client can communicate cancellation of the Claim My Tax Ltd agreement by any means of communication directly to Claim My Tax Ltd.
  • Claim My Tax Ltd reserve the right to cancel the clients claim at any stage, without any obligation of providing the client with a reason.

 

The Right to Terminate

  • The client can terminate their agreement with Claim My Tax Ltd at any time after the 14 days cancellation period (as explained above). In the event the client cancels after 14 days, the client will be charged a termination fee which will be calculated at £25 per hour to a maximum of 3 hours, for work carried out with regards to the tax rebate. If the client decides to terminate the agreement, Claim My Tax Ltd’s fee will be due in full if the client has already received an offer of rebate or has received a rebate from HMRC.

 

Complaints procedure

  • Claim My Tax Ltd have an internal complaints procedure in order to resolve complaints regarding our services provided. Should the client wish to make a complaint they can do so via complaints@claimmytax.co.uk or alternatively they may write to us at the registered address provided. Once a complaint has been made we aim to respond with an acknowledgment within 5 working days and aim to resolve the complaint in full within 8-12 weeks. A copy of our complaints procedure is available upon request.

 

Disclaimer

  • Claim My Tax Ltd is not responsible for the client providing incorrect, false, insufficient or misleading information. If incorrect, false, insufficient or misleading information is provided, Claim My Tax Ltd will not be liable if the claim results in an underpayment and the client will be expected to pay this themselves in full to HMRC.
  • In the instance that HMRC determine that a refund of tax has been made incorrectly and ask for it to be paid back. Claim My Tax Ltd are under no obligation to refund the fee however where possible we will do so.

Marriage Tax Allowance

Working From Home Tax Rebate

If your employer requires you to work at home, you can – and always have been able to – claim for increased costs due to working from home, eg, heating and electricity. But apportioning extra costs such as heating and electricity is tough. So instead you can, in simple terms, claim a rate of £6 a week.  

Mileage Tax Allowance

HMRC allows you to claim tax relief on mileage travelled whilst on business duties. If you use your own car for any of the following • visiting clients
• travelling to different offices • travelling to temporary work sites • making collections or dropping off goods. Then you could be eligible to claim your tax back. It doesn’t matter what type of vehicle you use.

PPI Tax Rebate

In April 2016 the personal savings allowance was introduced which allows taxpayers to earn up to £1,000 a year tax-free on their savings which includes the statutory interest paid on PPI claims.
Most people who have paid tax on PPI pay-outs since then, are entitled to some money back.
